A Cautionary Note – When Competitors Meet, Anti-Trust Issues Follow
As we prepare for the upcoming NFRC meeting in San Antonio, it’s a good idea to remind our meeting attendees about the potential for illegal activities. We are scrupulous about providing antitrust memos to our meeting attendees in registration packets and have antitrust reminders on each of our meeting agendas; but, there is no such thing as being too cautious when it comes to this issue.
Please remember that groups of competitors, whether manufacturers, laboratories, or Inspection Agencies (IA’s), should never meet together privately. Doing so can potentially influence how NFRC programs are operated – which ultimately result in affecting decisions that affect consumers and other parties. It is absolutely illegal to have any group of competitors discuss in private any issues that can affect program rules, program enforcement, or program cost.
Let us always make decisions openly, with our consumers (and customers) in mind. Let us be fair and consistent and use due process in our discussions, and always have either NFRC staff or legal counsel present at any meetings or conference calls to help ensure that all discussions are appropriate, effective, and legal.
